The Simple Food Project Shipping Policy

1. Introduction & Scope

This Shipping Policy (“Policy”) governs the processing, shipment, delivery, returns, and related obligations for all orders placed through The Simple Food Project’s website. By placing an order, you (“Customer”) agree to this Policy and our Terms of Service.

2. Definitions

  1. “Business Day” means Monday through Friday, excluding federal U.S. holidays.

  2. “Carrier” means any third-party shipping service (e.g., USPS, UPS, FedEx).

  3. “Order” means a Customer’s confirmed purchase of goods through our Site.

  4. “Shipment” means an Order that has been picked, packed, and tendered to a Carrier.

3. Processing & Domestic Shipping

3.1 Processing Time. Orders ship within one to two (1–2) Business Days after order confirmation, subject to payment authorization and inventory availability.

3.2 Delivery Estimate. Domestic Shipments typically arrive three to six (3–6) Business Days after tender to the Carrier. Delivery dates are estimates only; we are not liable for Carrier delays.

3.3 Insurance. All domestic Orders over US $100 are automatically insured against loss or damage in transit, up to the full purchase price.

4. International Shipping

By submitting an Order with a ship-to address outside the United States, you agree to:

  1. Customs & Duties. You are solely responsible for all import duties, taxes, customs fees, and clearance charges levied by your country. We will provide standard export documentation but cannot guarantee clearance or intervene with customs authorities.

  2. Risk of Loss. Title and risk of loss for International Shipments transfer to you upon tender to the Carrier. We are not responsible for lost, stolen, misdelivered, or untraceable packages once in the Carrier’s possession.

  3. Returns from Customs. If your Shipment is refused or returned by customs unopened, you may receive a partial refund for the merchandise only (shipping, duties, and fees are non-refundable). You may request reshipment at your own expense.

5. Order Cancellations & Returns

5.1 Pre-Shipment Cancellations. Contact Customer Care immediately to cancel. If the Order has not yet shipped, we will cancel and refund all payments.

5.2 Post-Shipment Returns. Once an Order ships, cancellations convert to returns:

  1. We will issue a prepaid return label.

  2. You must return items in original, unopened condition.

  3. Upon receipt, we will refund product costs less the actual return-label fee. Refunds process within 5–10 Business Days of receipt.

6. Carrier-Specific Requests

If you request a Carrier or service tier outside our flat-rate options, you must pay the full shipping cost difference.

Rationale: We negotiate volume-based flat-rate discounts with select Carriers. Alternative services forego those discounts.

7. Limitations of Liability

Except as required by law, The Simple Food Project’s maximum liability for any Shipment is limited to the lesser of (a) the purchase price paid for the affected goods or (b) the amount recoverable from the Carrier. We are not liable for consequential, incidental, punitive, or special damages.

8. Force Majeure

We shall not be liable for failure to perform or delays caused by events beyond our reasonable control, including but not limited to natural disasters, acts of God, government actions, pandemics, labor disputes, or Carrier-imposed delays.

9. Indemnification

You agree to indemnify and hold The Simple Food Project, its officers, directors, employees, and agents harmless from any claims, liabilities, losses, or expenses (including attorneys’ fees) arising from your breach of this Policy or misuse of our Site.

10. Governing Law & Jurisdiction

This Policy and all disputes arising hereunder are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. You agree that any legal action must be filed in the state or federal courts located in Waukesha County, Wisconsin.

11. Severability

If any provision of this Policy is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12. Amendments

We reserve the right to modify this Policy at any time. Material changes will be posted on our Site with an updated “Last Updated” date. Your continued use of the Site or placement of an Order after such changes constitutes your acceptance of the revised Policy.
